Terms of Use

1. Agreement

These Terms of Use (“Terms”) govern your use of the WakeBomb iOS application, wakebomb.com, and related services (together, the “Service”) provided by Komei Kinjo, Ogibashi, Koto City, Tokyo, Japan (“we,” “us,” or “our”).

By downloading, purchasing, or using the Service, you agree to these Terms and the Privacy Policy. If you do not agree, do not use the Service.

2. Eligibility and app license

You must be legally capable of entering into these Terms. If you are not, a parent or legal guardian must agree to these Terms and supervise your use of the Service.

Your license to use the iOS application is also subject to Apple’s applicable App Store terms and the Apple Standard End User License Agreement.

3. Use of alarm features

Alarm operation depends on the device, iOS, system services, permissions, battery, volume, audio output, and the settings selected by the user. No software alarm can be guaranteed to sound in every circumstance.

You are responsible for checking the alarm time, repeat days, sound, volume, permissions, and device condition. Use an independent backup alarm when a missed alarm could cause injury, danger, or significant loss.

4. Missions and physical activity

Some missions use the camera, motion sensors, step count, or physical exercises. Use these features only in a safe location and within your physical ability. Stop immediately if you experience pain, dizziness, shortness of breath, or other discomfort.

The Service does not provide medical advice and is not a medical or fitness device. Consult a qualified professional before performing physical missions if you have a medical condition, injury, disability, are pregnant, or have concerns about exercise.

5. Lock, blocking, and Penalty Alarm features

Lock Mode, Hard Mode, and App Blocking can restrict changes within WakeBomb or access to selected apps according to your settings and the capabilities of iOS. Review the selected apps and time period before enabling these features. Do not block access that you may need for safety or an emergency.

If you enable Penalty Alarm, WakeBomb may schedule an additional alarm within the time range you select after an unsuccessful wake-up. You are responsible for reviewing the time range and disabling the feature when it is not appropriate for your circumstances.

6. Purchases and subscriptions

PRO may be offered as a monthly subscription, annual subscription, or one-time Lifetime purchase. The available products, price, billing period, and included features are shown before purchase.

Purchases are processed by Apple and charged to your Apple ID. Subscriptions renew automatically unless canceled before the end of the current billing period. You can manage or cancel a subscription in your App Store account settings. Deleting the app does not cancel a subscription.

A Lifetime purchase provides access to the PRO features included with that product without a recurring subscription, for as long as WakeBomb remains available and supported on a compatible device. Purchases can be restored using the same Apple ID where supported. Refunds are handled by Apple in accordance with its policies and applicable law.

7. Tickets

Tickets are digital units that may be earned and used only within WakeBomb under the rules shown in the app. Tickets have no monetary value, cannot be exchanged for money, and cannot be sold or transferred except through a transfer feature provided by WakeBomb. Earning and redemption rules may be changed for future activity.

8. Acceptable use

You must not:

  • use the Service in violation of law or the rights of another person;
  • interfere with, damage, overload, or gain unauthorized access to the Service;
  • circumvent purchase, access, security, or usage restrictions;
  • reverse engineer, copy, modify, or distribute the Service except where applicable law expressly permits it; or
  • use automated means to access the Service in a manner not authorized by us.

9. Intellectual property

The Service, including its software, design, text, graphics, trademarks, and other content, is owned by us or our licensors and is protected by applicable law. Except for the limited license granted under these Terms and the Apple Standard End User License Agreement, no right or license is granted to you.

10. Availability and termination

We may update, modify, suspend, or discontinue all or part of the Service where reasonably necessary for operation, security, legal compliance, or product changes. We do not guarantee that every feature will remain available on every device or iOS version.

We may restrict or terminate access to the Service if you materially violate these Terms or use the Service in a way that creates a security or legal risk. Provisions that by their nature should survive termination will remain in effect.

11. Disclaimers

To the maximum extent permitted by law, the Service is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or compatible with every device or system configuration.

Nothing in these Terms excludes any warranty or consumer right that cannot be excluded under applicable law.

12. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss arising from a missed, delayed, or unintended alarm, unavailable notification, interrupted blocking feature, loss of data, or inability to use the Service.

Where liability cannot be excluded, our aggregate liability arising from the Service will not exceed the amount you paid for the Service during the 12 months before the event giving rise to the claim. These limitations do not apply to liability that cannot be limited under applicable law, including liability for intent or gross negligence where such an exclusion is prohibited.

13. Governing law

These Terms are governed by the laws of Japan, without regard to conflict-of-law rules. This does not deprive you of mandatory consumer protections or access to courts available under the law of your country of residence.

14. Changes to these Terms

We may update these Terms from time to time. We will post the updated Terms on this page and revise the “Last updated” date. We will provide additional notice where required by law. If you do not agree to updated Terms, you must stop using the Service.
